Distance sales agreement
This agreement governs buying a HekimBis subscription online under Turkish distance sales rules: the parties' details, the service and its price, payment and performance, the scope of the right of withdrawal, and how disputes are resolved.

Buyer: The person or organization placing the order, registered with the details given during the order.
2. Subject of the agreement
The subject of the agreement is the provision to the Buyer, electronically and for the selected period, of the HekimBis subscription plan (Lite, Pro or Clinic) selected in the site's order flow, and of any add-ons. The plan's scope, included capacities and limits are shown to the Buyer before ordering and are completed by the Subscription Agreement.
3. Pre-contract information
Before ordering, the Buyer acknowledges having been informed of the following:
- The essential characteristics, scope and included capacities of the service
- The total price of the service, whether tax is included, the payment period and renewal terms
- The payment and performance method; that the service is delivered electronically
- Information on the right of withdrawal and exceptions
- Complaint and application routes
- The Seller's identity and contact details
If price information is not published on the site, the Buyer requests a quote; no contract is formed unless the quote is accepted.
4. Formation and performance
The agreement is formed when the Buyer completes the order flow and a successful payment result is verified from the payment service provider. The service is opened for use in the Buyer's account electronically, after the agreement is formed and the necessary verification steps are completed. For services where conditions such as authority to represent the organization, facility permit or relevant registration must be verified, the relevant features may not be opened before verification is complete.
5. Price and payment
The price is the amount shown during the order. Payment is taken in the secure environment of a payment service provider; card details are not stored by the Seller. If payment fails, the service is not opened. If payment fails at renewal, the Buyer is notified and retry and a grace period apply; access to clinical records is not cut abruptly because of a payment problem but is managed through a controlled process.
6. Right of withdrawal
If the Buyer is a consumer, they may exercise the right of withdrawal in distance contracts without giving a reason and without paying a penalty, within fourteen days of the date the contract is formed. Notice of withdrawal is given in writing (including email) to one of the contact channels in this agreement.
Under the Regulation, the right of withdrawal cannot be used for services performed instantly in electronic form and for services whose performance has begun with the consumer's approval before the withdrawal period ends. If the Buyer asks for performance of the service to begin before the withdrawal period ends with their own approval, they are informed in advance that this request may remove the right of withdrawal or require payment of the proportionate part of the price. This approval is taken as a separate step in the order flow.
The free trial period is not a paid contract and is not subject to the right of withdrawal. In case of withdrawal, the price to be refunded is returned within the period set by the Regulation and by the payment method used.
7. Buyer's obligations
The Buyer accepts that the information they give is accurate, that they will use the service lawfully, that they are responsible for account security and that, as data controller, they are themselves responsible for the lawful processing of the personal data they enter into the system. Details are in the Terms of Service and the Data Processing Agreement.
8. Force majeure
Events beyond the parties' control that are unforeseeable and unavoidable (natural disaster, war, epidemic, infrastructure and power outages, orders of public authorities, etc.) release the party from liability, limited to the duration of the event, when obligations cannot temporarily be fulfilled.
9. Dispute resolution
If the Buyer is a consumer, within the monetary limits set each year by the Ministry of Trade they may apply to the Consumer Arbitration Committees at their place of residence or the place where the contract was made, and for disputes above those limits to Consumer Courts. If the Buyer is not a consumer, the courts and enforcement offices of Mersin are competent.
10. Effect
The Buyer accepts that they have read and approved this agreement and the pre-contract information electronically in the order flow. The agreement takes effect with order confirmation.
